TO PARTICIPATE IN THE EVENT “IT HR Forum”
1. GENERAL PROVISIONS
1.1. This document (hereinafter referred to as the Offer) is an official offer of the FOP Kikhtenko O.O. (hereinafter the “Executor”), valid on the basis of the Certificate of State Registration JSC series No. 406754 dated January 30, 2014, on the one hand, regarding the participation of an individual ( Customer) in IT HR Forum on the selection and management of human resources (hereinafter referred to as the Conference) and expresses the Contractor’s intention to enter into a contract on the terms of this Offer. This contract is public, that is, according to Article 633 of the Civil Code of Ukraine, its conditions are the same for all consumers.
1.2. In accordance with paragraph 2 of Article 642 of the Civil Code of Ukraine (CCU), in the case of acceptance of the following conditions and payment for services, the legal entity or individual who accepts this offer in this way becomes the Customer. By agreeing to this offer, the Customer confirms that he has fully read and agrees to its terms.
1.3. In connection with the above, study the text of this public Offer and, if you do not agree with any of its clauses, the Contractor suggests that you refuse to use the services.
2. SUBJECT OFFERS
2.1. The subject of this Offer is to grant the Customer the right to participate in the Conference July 3 and 6, 2023, which will be held at: Poland, Warsaw, CIC Warsaw, Chmielna 73
The Customer undertakes to pay for these services in accordance with the terms of this Public Offer and the current price list (hereinafter “Price List”) of the Contractor.
2.2. The real public Offer and the Price List are official documents and are published on the website https://ithrforum.eu in the “Prices” section.
2.3. The Contractor has the right to unilaterally change the Price List and the conditions of this public Offer at any time without prior agreement with the Customer, while ensuring the publication of the changed conditions on the website https://ithrforum.eu/ not less than one calendar day before their implementation.
3. DESCRIPTION OF SERVICES
3.1. In accordance with the subject of this public Offer, the Contractor grants the Customer the right to participate in the Conference.
4. TERMS AND CONDITIONS OF PROVISION OF SERVICES
4.1. Having familiarized himself with the current version of the Price List, the Customer pays the payment invoice issued by the Contractor.
4.2. After the Customer pays the issued invoice and funds are credited to the Contractor’s current account, this Agreement enters into force.
4.3. The services are considered to be provided properly and in full, if the Customer does not file a complaint within one day from the end of the service provision.
5. OBLIGATIONS OF THE PERFORMER
5.1. Provide the Services in full, in the proper manner and within the terms stipulated in this Agreement.
5.2. Provide the Customer with informative and methodical materials.
5.3. Timely post changes in the conference program on the official website of the conference and on pages in social networks.
5.4. In the event of a change in the terms of service provision, notify the Customer no later than 2 (2) working days before the start of service provision.
5.5. The performer has the right to refuse to attend the conference, without explaining the reasons, until the payment for participation has been made.
6. OBLIGATIONS OF THE CUSTOMER
6.1. Make payment in the amount specified in the Price List.
6.2. Ensure attendance at the conference.
6.3. Specify your real Name and Surname during registration.
6.4. Not to take any actions and proposals that give grounds for legal prosecution of both the Contractor and the Customer within the framework of this Agreement.
7. CONTRACT TERMINATION PROCEDURE
7.1. The Contractor has the right to refuse to perform this Agreement at any time, provided that the amount of money paid to the Contractor is reimbursed to the Customer and with mandatory notification of the Customer in writing, by e-mail or by fax at least 5 (five) working days in advance until the expected date of termination of the Agreement.
7.2. The Customer has the right to refuse to perform this Agreement at any time, with mandatory notification to the Contractor in writing, by e-mail or by fax. At the same time, the following refund policy applies:
- in case of refusal 3–10 days before the conference – 50% of the payment amount is returned;
- in case of refusal 2 days or less before the conference – the Contractor does not refund funds.
8. RESPONSIBILITY OF THE PARTIES
8.1. For non-fulfillment or improper fulfillment of their obligations under this contract, the parties bear the responsibility provided for by the legislation of Ukraine and this contract.
8.2. The parties are not responsible for the occurrence of force majeure circumstances (unforeseen, unavoidable, uncontrollable phenomena and events: natural disasters, strikes, lock-downs, etc.), of which they are obliged to notify the other party in writing no later than the next day of their occurrence with documentary confirmation.
9. DURATION OF THE AGREEMENT
9.1. The Agreement enters into force from the moment specified in Clause 4.2 of this Offer, and is valid until the Parties fulfill their obligations.
10. DISPUTES OF THE PARTIES
10.1. In the event of disagreements or disputes on issues arising from or related to this contract, the parties will take all measures to resolve them through negotiations in an atmosphere of commonwealth and mutual understanding. If an agreement is not reached, disputes are resolved in accordance with the procedure established by the current Law of Ukraine.
10.2. The Contractor is released from responsibility for the violation of the terms of this Offer, if such violation is caused by the action of force majeure circumstances (circumstances of force majeure). Such actions, in particular, are the actions of state authorities, local governments, lockdowns, fire, flood, earthquake, other natural disasters, lack of electricity and/or computer network failures, strikes, civil disturbances, riots. Also, the problems that caused the disruption of the event due to political events in the country.
